These Terms of Service ("Terms") are a contract between Locar and the car rental company that creates an account or accepts an invitation to use the Locar platform ("Customer", "you", "your"). They govern your company's access to and use of the service.
Locar is provided for business customers only. These Terms are a business-to-business agreement; they are not a consumer contract, and the protections available to consumers under applicable law do not apply to the Customer's use of the service. By creating an account, accepting an invitation to a company account, or otherwise using the service, you confirm that you are acting on behalf of a business and that you are authorised to accept these Terms for it.
The service
Locar is a software-as-a-service platform for independent car rental companies, mainly in Spain and Portugal. It helps the Customer manage its fleet, bookings, contracts, customers, drivers, payments and related documents, through an administration console and a tablet application for staff handling vehicle hand-overs and returns.
The service is made up of a core platform and optional modules and features, some of which (such as WhatsApp messaging and AI-assisted features) are available only if enabled for the Customer's account. We may add, change or retire individual features over time, in a way that does not materially reduce the overall functionality the Customer has paid for, without this being a change to these Terms.
Accounts and users
The Customer's company owner creates the company account and may invite other individuals ("users") to use it with roles and permissions that control what they can see and do. Each user acts on behalf of the Customer, and the Customer is responsible for the acts of every user it invites.
The Customer must provide accurate information when creating the account and keep it up to date. The Customer is responsible for everything that happens under its account, whether done by it or by a user it has invited, except where caused by our own breach of these Terms. The Customer must:
- keep every user's login credentials confidential and secure
- only invite individuals who are authorised to act on the Customer's behalf
- remove a user's access promptly once it should no longer have it
- tell us without undue delay about any unauthorised use of an account
Free trial, plans and billing
New companies can try Locar free of charge for a trial period before deciding to subscribe. No card is charged during the trial.
Once the trial ends, an account without an active paid subscription becomes read-only:
- rentals already in progress can still be returned and paid
- new bookings and other changes are blocked until the account is paid
Paid plans are billed monthly or yearly through our payment provider, Stripe. Prices are shown to the Customer at sign-up or on the plan page before VAT, which is added where it applies. Additional modules may be sold separately from the core plan.
A paid subscription renews automatically for the same billing period unless the Customer cancels before the renewal date. Cancelling stops future renewals; it does not entitle the Customer to a refund of the period already paid for, except where the law requires one.
Acceptable use
The Customer must use the service only for lawful purposes connected with operating its car rental business, and must ensure its users do the same. The Customer must:
- use WhatsApp messaging features only within Meta's WhatsApp Business Platform policies, and only to message customers who have given their consent; never to send unsolicited bulk messages
- not use the service to send unlawful, defamatory, infringing or deceptive content
- not attempt to bypass or weaken the service's tenant, security or access controls, or access data belonging to another company
- not use the service in a way that places an unreasonable load on it, or that attempts to disrupt it for other customers
The Customer is solely responsible for the personal data of its own customers and drivers that it collects, stores and processes using the service, and for having a lawful basis for doing so under applicable data protection law.
Your customers' data and the DPA
For the data the Customer holds about its own customers and drivers through the service — such as identity and driving-licence details, signatures, bookings, contracts, payments, damage photos and WhatsApp conversations — the Customer is the controller and Locar is the processor, acting only on the Customer's instructions.
The terms of that processing are set out in our Data Processing Agreement, published at /legal/dpa, which forms part of these Terms and applies automatically to every Customer.
The service includes built-in tools for the Customer to export a customer's data and to erase a customer's personal files, other than records we must keep as legal evidence.
AI features
Some features use artificial intelligence to assist the Customer's staff, for example reading identity and vehicle documents, translating messages, transcribing voice notes, or helping draft a WhatsApp booking reply.
These features produce suggestions, not decisions. They are not always accurate, and Locar gives no guarantee of accuracy. A person at the Customer must review and confirm an AI-generated suggestion before it is saved to a customer, vehicle, booking or any other record.
Third-party services
The service relies on third-party providers for some features, including Meta Platforms (WhatsApp messaging) and Stripe (card payments and billing). Use of those features is also subject to the relevant provider's own terms, and may involve fees charged directly by that provider, such as WhatsApp message fees from Meta or card-processing fees from Stripe.
Locar is not responsible for the acts, omissions, unavailability or pricing of a third-party provider, to the extent this is outside our reasonable control.
Availability and support
We make reasonable efforts to keep the service available and to carry out maintenance at times and in a way that limits disruption, with notice in advance where reasonably possible. We do not guarantee that the service will be available without interruption or error-free.
Support is provided by email at support@locar.ai. We make reasonable efforts to respond and to resolve issues, but these Terms do not set a guaranteed response or resolution time.
Intellectual property
Locar and its licensors own all intellectual property rights in the service, including its software, design and the Locar name and branding. These Terms give the Customer a limited, non-exclusive, non-transferable right to use the service during its subscription, for its own business, and no other rights.
The Customer keeps ownership of the data it enters into the service, such as its fleet, bookings, customer and contract records. The Customer gives Locar the right to host, process and display that data only to provide the service to the Customer.
Confidentiality
Each party must keep confidential any non-public information it learns about the other through these Terms, and use it only to perform or receive the service, unless the other party agrees otherwise, the law requires disclosure, or the information is already public or independently known.
This obligation continues after these Terms end, for as long as the information remains confidential.
Warranties and liability
The service is provided "as is" and "as available". To the extent permitted by law, Locar gives no warranty beyond those expressly stated in these Terms and those that cannot be excluded by applicable law.
To the extent permitted by law, each party's total liability arising out of or in connection with these Terms, however caused, is limited to the fees the Customer paid in the 12 months before the event giving rise to the claim. Neither party excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
Neither party is liable for indirect or consequential loss, including lost profits, lost business or lost data, except where that loss cannot be excluded by law.
Term and termination
These Terms apply for as long as the Customer has an account. The Customer may cancel its subscription at any time; cancellation takes effect at the end of the current billing period.
Locar may suspend or end the Customer's access if the Customer seriously or repeatedly breaches these Terms, including by not paying fees that are due, after giving reasonable notice and a chance to fix the breach where that is practical.
Before closing its account, the Customer should export or keep whatever it needs — such as contracts and invoices — using the service's built-in, per-customer export tool. Once the account is closed, Locar deletes all of the Customer's data, including records kept as evidence, except records Locar must itself keep by law, such as its own invoices to the Customer.
Changes to these Terms
We may update these Terms from time to time, for example to reflect a change in the service or in the law. We will give the Customer reasonable notice of a material change before it takes effect.
The version and date of these Terms currently in effect are shown at the top of this page.
Governing law and courts
These Terms are governed by Spanish law. Any dispute arising out of or in connection with them is subject to the exclusive jurisdiction of the courts of Spain, unless mandatory law gives the Customer the right to bring proceedings in another jurisdiction.
